Furthermore, in December 2024, she filed nomination papers for a City Council seat in District 5 using the same address. Evidence suggests that Kim was actively attempting to establish fraudulent residency to enhance her candidacy.

In January 2025, Kim allegedly made a $400 deposit for a room for rent at a home on Willowrun in District 5 and updated her driver’s registration to that address shortly thereafter, filing new nomination paperwork soon after her move. However, her voter registration and candidacy came under scrutiny leading to a petition submitted to the Orange County Registrar of Voters in January 2025.

On February 7, 2025, an Orange County Superior Court judge approved a petition that removed Kim’s name from the ballot for the upcoming April 15, 2025, Special Election, which was ultimately won by Betty Martinez Franco. The allegations concerning Kim’s fraudulent representations were initially brought to the Orange County District Attorney’s Office by an Irvine resident who expressed concerns about her claims of residency.
